PREAMBLE
In conformity with the French Consumer Code and more specifically Article L.111-1 thereof, these General Terms and Conditions govern the sale of goods via the website Roi de Sicile (www.roidesicile.com and www.rdsgallery.com) (hereinafter the "Site") and define the rights and obligations of the parties.
ARTICLE 1 — IDENTIFICATION
The Site is operated by Adrian Grinspan, trading under the name Roi de Sicile / RDS Gallery, a micro-enterprise registered with the Paris RCS under SIRET number 840 496 657 00023, with registered address at 25 rue du Roi de Sicile, 75004 Paris, France.
The Site allows individuals and professionals (collectively "Customers") to purchase antiques, decorative arts objects and other items listed on the Site (collectively "Products").
ARTICLE 2 — OBJECT
These General Terms and Conditions of Sale (hereinafter "General Conditions") comply with French legal obligations, including the Consumer Code. They define the terms and conditions of sale and govern the rights and obligations of ROI DE SICILE and the Customer.
ARTICLE 3 — GENERAL PROVISIONS
These General Conditions supersede and replace all prior agreements, offers or documents, whether written or oral, relating to the same subject matter. They apply to all sales made through the Site and express the entire agreement between ROI DE SICILE and the Customer.
ROI DE SICILE reserves the right to amend these General Conditions at any time by publishing a revised version on the Site. The conditions applicable to an order are those in force on the date of payment. These conditions may be supplemented by specific terms, which shall prevail in the event of contradiction.
These General Conditions are available at all times on the Site and may be printed directly from any page. Contact: roidesicilecontact@gmail.com.
ARTICLE 4 — ACCEPTANCE
By placing an order on the Site, the Customer acknowledges having read and accepted these General Conditions in full. Acceptance is confirmed by ticking the relevant checkbox at the time of order validation.
ARTICLE 5 — USE OF THE SITE
The Site and its Services are accessible to any natural person with full legal capacity under French law. By using the Site, the Customer confirms that they meet this requirement. Information recorded by ROI DE SICILE constitutes legal proof of transactions.
I. PRODUCTS
Article 1 — Description of Products
The Site offers antiques, decorative arts objects, furniture, lighting and other items in new or second-hand condition. Many pieces are rare or unique. Each item is described according to its specific characteristics including age, origin, material and condition. Each item is unique and cannot be replaced or exchanged.
In accordance with Article L.111-1 of the Consumer Code, the Customer may, before placing any order, request further information about any Product by contacting ROI DE SICILE at: roidesicilecontact@gmail.com.
Product condition is indicated on each product page. The following definitions apply:
As new: No or barely perceptible signs of use.
Excellent condition: Minor signs of use, nothing significant.
Very good condition: Some signs of use.
Good condition: Visible signs of use but item remains in good overall state.
As found / current condition: May have missing elements or damage; sold as is.
Photographs and descriptions are prepared as carefully as possible. ROI DE SICILE is only committed to what is expressly stated in the product description. The Customer acknowledges that, given the nature of antique and vintage objects, second-hand items may carry marks, signs of use and minor defects that form part of their character and value.
Article 2 — Availability
Products offered on the Site are subject to availability. ROI DE SICILE endeavours to keep the Site up to date but cannot guarantee real-time accuracy. If a Product ordered is unavailable, the Customer will be notified promptly and reimbursed in full. This circumstance shall not give rise to any liability on the part of ROI DE SICILE.
II. REGISTRATION
Article 1 — Registration
Visitors may browse the Site without registering. However, registration is required to place an order and must be completed no later than the time of order validation. Professional Customers must provide a valid K-bis extract or equivalent document confirming their professional status in antiques, decoration, interior design or related fields.
Article 2 — Customer Account
Registration creates a personal Customer Account giving access to a personal space where the Customer can manage orders and wishlists. The Customer is responsible for maintaining the accuracy of their account information and the confidentiality of their login credentials.
Any use of the Services from the Customer's account is deemed to have been made by the Customer. In the event of unauthorised use, the Customer must notify ROI DE SICILE immediately. ROI DE SICILE reserves the right to delete any account that breaches these General Conditions without compensation.
III. ORDERING
Article 1 — Purchase Process
The Customer selects Products and adds them to their basket. At checkout, they confirm the contents, review the total price including delivery costs, and may apply any valid discount codes. The order is finalised upon payment.
ROI DE SICILE will send an acknowledgement of receipt within 24 hours of receiving payment, together with a summary of the order.
Article 2 — Offers and Counter-offers
The Customer may submit an offer via the contact form or by email to roidesicilecontact@gmail.com. Any offer submitted constitutes a firm and binding offer to purchase at the stated price. ROI DE SICILE may accept, refuse or submit a counter-offer at its sole discretion, without obligation to provide justification.
IV. SHIPPING AND DELIVERY
Article 1 — Delivery Areas
ROI DE SICILE ships worldwide unless otherwise indicated at the time of order.
Article 2 — Delivery Costs
Delivery costs are borne by the Customer and are indicated in the basket at checkout. For certain destinations, a quote may be required. Delivery costs do not include import duties, customs fees or local taxes, which are the sole responsibility of the Customer.
Personal collection is available free of charge at the address of ROI DE SICILE in Paris. Free delivery within Paris is available for orders over €300. The Customer may also arrange their own carrier by contacting ROI DE SICILE before placing the order.
Article 3 — Carriers
ROI DE SICILE uses Colissimo for most shipments, and UPS, Chronopost or DHL for expedited or international deliveries. For fragile or oversized pieces, specialist art handlers or independent carriers may be used.
Article 4 — Delivery Times
ROI DE SICILE undertakes to dispatch orders within 90 days of confirmed payment. Shipping times vary by destination. Deliveries within France and Europe typically arrive within one week. Shipments to Asia and the Americas usually arrive within one month via standard services.
Article 5 — Cancellation for Non-Delivery
In the event of failure to deliver within the agreed timeframe, and in accordance with Article L.216-2 of the Consumer Code, the Customer may cancel the order by registered letter after first giving notice to ROI DE SICILE. A full refund including delivery costs will be issued within 14 days of cancellation.
Article 6 — Receipt and Damage
In the event of visibly damaged packaging or incomplete delivery, the Customer must refuse the package and notify ROI DE SICILE immediately by email. In accordance with Article L.133-3 of the Commercial Code, any claim against the carrier must be made within three days of receipt by registered letter. Failure to do so extinguishes any right of recourse.
Aesthetic wear, minor marks and signs of use consistent with the age and nature of the items sold do not constitute defects and may not be enforced against ROI DE SICILE.
V. PRICES AND PAYMENT
Article 1 — Prices
Prices are displayed in Euros (€), inclusive of all applicable taxes. ROI DE SICILE reserves the right to modify prices at any time. The price applicable to an order is that in force on the date of payment. For deliveries outside the European Union, import duties and customs fees may apply and are the sole responsibility of the Customer.
Article 2 — Professional Rates
Verified Professional Customers benefit from a personal, non-transferable discount code corresponding to a professional rate. This code must be entered manually at checkout and cannot be combined with other promotional codes. Misuse of the code may result in account suspension.
Article 3 — Payment Methods
Payment is due in full at the time of order. ROI DE SICILE accepts the following payment methods:
Credit and debit cards via the secure online checkout, powered by Stripe.
Bank transfer — contact ROI DE SICILE for bank details.
ROI DE SICILE does not have access to any card data entered during payment. Delivery times begin from the date of confirmed receipt of payment. Orders unpaid within 8 days will be cancelled and Products relisted.
Article 4 — Retention of Title
Products remain the property of ROI DE SICILE until full payment has been received. Risk transfers to the Customer upon handover to the carrier, in accordance with Article L.216-4 of the Consumer Code.
VI. WARRANTIES
Article 1 — Legal Guarantee of Conformity
In accordance with Articles L.217-4 et seq. of the Consumer Code, Customers benefit from the legal guarantee of conformity. The Customer has 24 months from delivery to invoke this guarantee (reduced to 6 months for second-hand goods). The Customer may opt for repair or replacement of the Product.
Article 2 — Guarantee Against Hidden Defects
Customers also benefit from the guarantee against hidden defects under Article 1641 of the Civil Code. In the event of a hidden defect, the Customer may choose between rescission of the sale (return of the item against refund of the price) or a reduction in the sale price.
To invoke this guarantee, the Customer must notify ROI DE SICILE promptly at roidesicilecontact@gmail.com, specifying the nature of the defect. ROI DE SICILE will arrange and bear the cost of return. Products must be returned in their original or equivalent packaging, accompanied by the purchase invoice. Refund will be made within 14 days of ROI DE SICILE confirming the defect.
VII. RIGHT OF WITHDRAWAL
Article 1 — General
Individual (non-professional) Customers have the right to withdraw from their purchase without giving reasons within 14 days of taking physical possession of the goods.
Article 2 — Exercise of the Right
To exercise this right, the Customer must notify ROI DE SICILE by unambiguous declaration (letter or email to roidesicilecontact@gmail.com) before the expiry of the 14-day period. The Customer may use the withdrawal form provided at the end of this document. Products must be returned within 14 days of notification, in their original condition and packaging, accompanied by a copy of the purchase invoice. Return costs are borne by the Customer.
Article 3 — Exclusions
The right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalised, in accordance with Article L.221-28 of the Consumer Code.
Article 4 — Refund
Upon receipt of the returned Products in satisfactory condition, ROI DE SICILE will refund all sums paid, excluding return costs, within 14 days.
VIII. AUTHENTICITY
ROI DE SICILE undertakes to indicate, for each Product, the date of production (approximate where uncertain), the name of the maker or designer where known and documented. Certificates of authenticity may be requested by email.
Every piece offered has been personally researched and authenticated before listing. Where relevant, ROI DE SICILE cross-references catalogue raisonnés, auction house records and archive documentation.
IX. INTELLECTUAL PROPERTY
All elements of this Site — text, images, photographs, graphics and structure — are the property of ROI DE SICILE and are protected by intellectual property law. Any reproduction, distribution or use without express prior authorisation from ROI DE SICILE may give rise to legal action.
X. LIABILITY
ROI DE SICILE undertakes to provide its services diligently and in good faith. It operates under an obligation of means, not of result. ROI DE SICILE shall not be liable for delays or failures resulting from force majeure, disruptions to postal or transport services, or other circumstances beyond its control.
ROI DE SICILE's liability is limited to direct damages resulting from a proven breach of its contractual obligations. Indirect damages, including loss of profit or loss of opportunity, are expressly excluded. Any claim must be submitted by registered letter within one month of the relevant event.
Colour rendering of Product photographs may vary depending on screen settings. These variations do not constitute grounds for liability.
XI. PERSONAL DATA AND PRIVACY
ROI DE SICILE collects personal data (name, address, email, telephone, order history) for the purposes of order processing, account management, commercial communications and statistical analysis. Data is retained for three years from the last commercial exchange.
In accordance with applicable data protection law, Customers have the right of access, rectification, erasure, portability, restriction and objection. These rights may be exercised by written request accompanied by valid proof of identity, sent to the address or email above. Customers may also contact the CNIL (www.cnil.fr) for further information.
XII. COOKIES
The Site uses cookies for traffic analysis, user experience improvement and session management. Cookies are retained for up to 6 months. The Customer may modify, block or delete cookies via their browser settings, though doing so may affect the functionality of certain services.
XIII. MEDIATION
In the event of a dispute, individual Customers may have recourse to a consumer mediator free of charge, in accordance with Articles L.152-1 of the Consumer Code. A list of approved mediators is available at: https://www.economie.gouv.fr/mediation-conso/liste-des-mediateurs-consommation.
XIV. APPLICABLE LAW AND JURISDICTION
These General Conditions are governed by French law. In the event of a dispute, the Courts of Paris shall have exclusive jurisdiction, subject to any mandatory procedural rules to the contrary.
XV. MISCELLANEOUS
If any clause of these General Conditions is declared void by a court, the remaining clauses shall continue in full force and effect. Failure by either party to invoke any clause shall not constitute a waiver of the right to do so in future.
